Illinois Jury Returns $8M Verdict To Estate Of Motorist Killed By Truck

An Illinois jury on March 22 awarded $ 8 million to the estate of a woman who was killed when she was struck by a truck on a highway, a source told Mealey Publications (Steven McHale v. Transfreight LLC, et al., No. 2010L2934F, Ill. Cir., Cook Co.).

Steven McHale sued Transfreight LLC, Kiswani Trucking Inc. and Russell A. Kleppe in the Cook County Circuit Court on behalf of the estate of his wife, Stacey McHale.

Flat Tire

Stacey McHale was fatally struck by an 18-wheel semi tractor-trailer on Feb. 15, 2010, as she stood on the shoulder of I-294 to investigate a flat tire.

Kleppe was the driver of the truck. The source said that at trial, Transfreight contended that the accident was not the corporation’s responsibility.

The source said the jury found that Kiswani and Kleppe were agents of Transfreight and that as a result, all three defendants were liable for McHale’s death.

The case was tried before Judge William J. Haddad.

Young Family

The source noted that McHale was 36 at the time of her death and left behind a daughter and son.
